The indictment filed against the two stated that Elimelech grabbed the security guard by the throat and his brother Tom pushed him hard in the chest until he fell to the floor and his glasses broke. All this happened because the brothers entered the building with an electric scooter and the security guard, according to the building guidelines, did not allow them to enter the building lobby with him. A violent argument ensued between the parties.
