Sony is facing a class action lawsuit over what was reported failure to honor warranty contracts on PlayStation 5 controllers with obvious “drift” defects.

In a complaint filed in New York’s Southern District on Feb. 12, the Japanese conglomerate is accused of violating consumer fraud laws and breaching warranty agreements related to the PS5 DualSense wireless controllers have an obvious flaw, which the suit says allows the characters to move across the screen even when a user isn’t moving the controller’s joystick.

Lmarc Turner, the main plaintiff listed in the complaint, argues that it immediately knowledge a a drift issue with the controller after bringing home his PS5 in early February. However, after contacting messenger services, Turner was reportedly left with some lame advice about troubleshooting the default administrator and little else in terms of help.

Finally, “[g]iven his experience of contacting Sony for the first time did not satisfactorily address a drift issue, ”Turner purchased another DualSense controller for $ 69.99 a few days later, though “There were [he] had been aware of the Drift Defect before he bought his PS5, otherwise he would not have bought the PS5, or he would have paid much less for it.The complaint states.

The suit also claims that Sony needed to know how widespread the a drift case was specifically cited “Online consumer complaints, consumer complaints directly to him, and through his own pre-release test.”

“This deficiency significantly impedes gameplay and thus undermines the core functionality of the DualSense Controller,” the complaint states.

The DualSense controllers have been released next to the PS5 console in November to many wait after selling out through preorder almost everywhere.

The lawsuit is suing Sony free recall or replacement program to replace the faulty controllers of class members, and also request damage payments payable out to customers to make a refund them to buy new or any other regulators out-of-pocket costs to repair the accused fault.
