“Hapoel Tel Aviv does not have to return Maor Buzaglo to training”

Adv. Amiel Tagar, the arbitrator in the arbitration proceedings between Maor Buzaglo and Hapoel Tel Aviv, decided tonight (Monday) to reject the player’s request to return to the team’s training. “I debated a lot, and finally came to the conclusion that in the circumstances that arose, the team could not be required to return the player to its ranks,” the arbitrator wrote in his decision.

As you may recall, after the Reds informed Buzaglo that his contract was canceled due to force majeure (the Corona crisis), the player filed an arbitration lawsuit against the club in the amount of about two million shekels. Advocate Tagar returned Buzaglo to training until January 31, in parallel with the continuation of the legal proceedings, when in the last month there were negotiations between the parties in an attempt to reach a compromise. Negotiations were unsuccessful and as stated the arbitrator ruled that the team is not obligated to return the player to training.

“I tried to bring the parties to an agreement regarding the player’s return to sports activity; this, in light of the importance of maintaining the player’s athletic fitness and because his return to activity would reduce his financial claims and thus make it easier for the team. “According to her, it is unlikely that the player will play in the team while the lawsuit he filed against her is pending. At one point it seemed that the gaps between the parties could be bridged, but the momentum was lost and the parties’ positions moved away. Therefore, there is no choice but to decide. .

Despite the decision, the arbitrator warns Hapoel regarding the decision of Buzaglo’s monetary claim. He wrote: “I hope that my decision will not be the end of the verse regarding the player’s participation in the team’s activities and that the parties will be able to resume negotiations between them in order to reach understandings on this issue, at the very least. The team must remember that there is a significant risk that the player’s claim will be accepted in the relevant components, so that at the end of the day you will be required to pay the player for the remaining three months until the end of the season regardless of waiving his services. This is how the team will lose times: it will also bear the payments it undertook to pay the player for this period and will not enjoy the possibility that it will contribute to its capacity. “It is clear that this decision refers only to the dimension of the team’s obligation to involve the player in its sports activities and does not mean that the player is not entitled to a salary for this period.”

Buzaglo’s representatives, Adv. Shai Elias and Adv. Roi Almadai They were optimistic about the decision and said: “We are pleased with the decision of the arbitrator who sends a message to Hapoel Tel Aviv that the chances of Maor Buzaglo’s claim being accepted are very high. The arbitrator also noted that Hapoel Tel Aviv’s position is not clear “A case, until the end of the season and its opposition to his return to the team, without a justifiable explanation, will expose her to pay double compensation, especially since Maor agreed to return for free.”
