The Jerusalem Magistrate’s Court is holding a hearing today (Fourth) on the Godfather family’s request to appoint an investigating judge to investigate the affair of the late Ahuvia Godak’s boy.
“I see myself as a judge who will investigate the circumstances of the boy’s death. At the end of the hearing I will take all the materials of the investigation for my consideration,” the whip Winshel announced.
Advocate Ariel Atari, who represents the family on behalf of the Honno organization, claimed at the hearing: “DIP decided not to interrogate the police that night, for this and other reasons DIP cannot remain the only one to investigate here.”
The hearing revealed that a number of senior prosecutors are involved in the case, including Deputy State Attorney Adv. Momi Lemberger and Adv. Nurit Littman. “The fact that the Ministry of Justice allows the police to obtain all the materials that DIP collects, indicates a serious failure, and deprives us of sleep,” added Adv. Atari at the hearing.
Adv. Atari further claimed: “We learn from the State Attorney’s Office’s words that already on that day the police’s action reports stated that there was contact between the vehicles. It is clear that already hours after the incident, DIP was known to have police officers whose act caused death. We also learn that the boys also said on the same day that the police officers hit them and killed the boy. That same day, DIP chief decides not to interrogate the police “Investigators, do not prevent the coordination of evidence, do not prevent disruption, in contrast to dealing with civilians in similar cases, the police arrived at the DIP offices and sent them home. I say in parentheses – continue to coordinate evidence.”
“At the same time, the Ministry of Justice – decides to include the police in the investigation as well, hence the DIP investigation is exposed to the police. And the original sin of before the establishment of DIP – police interrogation by police officers is repeated. The investigation was polluted. “
“For boys who have rolled his deadly attitude lightly, this is what happens when police officers are involved in the investigation. The victim becomes the accused, this is the biggest fear we have. Therefore, we will ask for the judge to enter the investigation, for the authorities,” Atari added.
The prosecution asked to conduct part of the hearing in one-sided class (excluding the boy’s family and her lawyer) if the court wanted to address the materials.
At the end of the hearing, Judge Winshel announced that he was taking the entire investigation file, and would review the matter.
