Representative Bennie Thompson is the first to sue Trump for conspiring to overthrow U.S. Congress under the 1871 Ku Klux Klan Act.
A federal lawsuit was filed Tuesday morning on behalf of Rep. Bennie Thompson against former President Donald J Trump and his personal attorney Rudy Giuliani alleging that they violated an Act Ku Klux Klan 1871 for inciting riots Jan. 6 at the United States Capitol.
The act, formally known as the “Fourteenth Amendment of the Constitution of the United States, and for Other Purposes” was enacted because the racist KKK launched a campaign for voters and murder against newly liberated Black U.S. citizens.
The 14th Amendment, agreed in 1868, grants citizenship to those born in the USA, who effectively ended slavery. The KKK Act includes protection against violent conspiracies that have undermined the constitutional obligations of Congress.
The suit, filed by the National Association for the Advancement of Colored People (NAACP), comes three days after Trump was acquitted in a Senate impeachment lawsuit based on allegations that he it was the riot, in which five people died. That freedom is likely to open the door to a new legal investigation into what Trump did before and during the siege.
While the impeachment case focused squarely on allegations of incitement, the broader lawsuit alleges that Trump complains that it will suspend Congress’ constitutional activity – that is, proof election results against new President Joe Biden as a legitimate winner – through a month-long attempt to derail. the outcome and pursuit of individual states and its own vice president to turn the competition around.
The suit follows Trump and Giuliani’s heinous attempt to question the election results even though courts across the country – and state election officials – have again rejected their unfounded claims for fraud.
Despite contradictory evidence, the suit says, the men showed the election as stolen while Trump “affirmed rather than discouraged” threats of violence from his angry supporters. in the weeks before the attack on the Capitol.
“The carefully managed series of events that took place at the Save America rally and the Capitol storm was not an accident or a coincidence,” the suit says. the expected and expected outcome of a carefully coordinated campaign to block the legal process required to determine the number of votes cast in the Electoral College . “
The lawsuit from Thompson, chairman of the House Committee on Homeland Security, is part of an expected wave of law over the Jan. 6 riot and is believed to be the first file by a member of Congress. He seeks punitive damages and anonymous compensation.
The case also cites groups including the Proud Boys and the Oath Guards, opposition groups with accused members of the Justice Department for participating in the siege.

Lawyers for Trump have denied that he sparked the riot. Trump’s adviser did not immediately comment on Tuesday’s lawsuit, and a lawyer for Giuliani did not immediately respond to the Associated Press’s request for comment.
Representatives Hank Johnson of Georgia and Bonnie Watson Coleman of New Jersey are expected to join together as planners in the coming weeks, the NAACP told the New York Times.
