In the district court’s decision, and following last night’s hearing on the Interior Ministry’s food voucher tender, it was decided today (Friday) that a restraining order is issued against Shufersal, given its refusal to reach a joint outline with Pethon Lev, which petitioned earlier this month.
At the end of the emergency hearing held for several hours yesterday, the court found defects and deficiencies in the conduct of Shufersal and the state in the tender and asked the parties to reach a compromise. Following the lack of consent, the court issued a restraining order that would stop Shufersal from continuing its activities until a ruling is received on the petition filed through Adv. Yaniv Metlas.
Eli Cohen, CEO of Pethon Lev: “We welcome the court’s decision, which heard the parties’ arguments for many hours yesterday and ruled that there are flaws in Shufersal’s conduct and that there is a chance that the winner of the tender will change. “After many efforts on our part to reach a compromise agreement, which aims for quick, professional and effective assistance to aid seekers across the country – we encountered an unfortunate refusal on the part of the parties and were forced, in the court’s decision, to close the hearing.”
He added that “the courageous decision for the restraining order for the tender means that problems in the conduct and documents were indeed identified and that the Shufersal chain did not act as required before the Ministry of the Interior. I hope that justice is served and the tender can be executed in the best possible training.”
As stated, as part of the tender, the bidders were required to offer points of sale in which the purchase tokens that the Ministry of the Interior intends to distribute will be honored. An in-depth inspection conducted by Pethon Lev revealed that dozens of points of sale that Shufersal presented in the tender documents did not receive any application from it and some did not even exist. Shufersal won the tender thanks to the high number of distribution points that it made available to the subject – 1,627 in number with Pethon Lev in second place.
